The phrase appears in handwritten notes made in prison by Epstein, released as part of the broader Epstein files document disclosures in early 2026. The notes, found in file EFTA00134596 and its adjacent release EFTA00134597, are scrawled on a yellow pad and contain words including "Israel," "Jet," "Visa," "Muslim," and "Gaza" — what all of this means when put together is genuinely unclear, and the writing could represent Epstein laying out a train of thought around some kind of plan, or the desperate scribblings of a man thinking only about himself. Even the outlet that first publicized the notation acknowledged it "may well" indicate Epstein expected to leave on the 10th of a month — but was equally candid that it might simply be the ramblings of a predatory child rapist who was becoming increasingly unhinged. No forensic document analyst, no law enforcement investigator, and no court has confirmed the theory's interpretation of the notation. The claim that this is a pre-written death date rests entirely on a coincidence of the number 10 and the date August 10 — and assumes the conclusion it purports to prove. The word "jail" preceding the number could plausibly refer to Epstein's own hopes of getting out of jail, a bail hearing, a legal deadline, a financial transfer, a flight plan, or any number of other things a man facing federal sex trafficking charges would be preoccupied with. The theory strips the notation of all context, assigns it the most sinister possible reading, and calls that reading "proof."

The factual record of Epstein's death does not support the murder hypothesis. According to the Department of Justice, after a thorough investigation, FBI investigators concluded that Epstein committed suicide, a conclusion consistent with the August 2019 autopsy findings of the New York City Office of the Chief Medical Examiner, the November 2019 position of the U.S. Attorney's Office for the Southern District of New York, and the June 2023 conclusions of the DOJ's Office of the Inspector General. The video evidence is particularly decisive for the murder scenario: the DOJ's memo states that "anyone entering or attempting to enter the tier where Epstein's cell was located … would have been captured by this footage," and the FBI's independent review confirmed that from the time Epstein was locked in his cell at around 10:40 p.m. on August 9, 2019, until around 6:30 a.m. the next morning, nobody entered any of the tiers. The autopsy findings further undermine homicide: the medical examiner detailed why Epstein's injuries were more consistent with suicide by hanging than homicide by strangulation, noted that blood toxicology tests revealed no medications or illegal substances in his system, and noted the absence of defensive wounds — marks on his hands, contusions to his knuckles, or bruises on his body — that would be expected if he had struggled with an attacker. Far from being a tightly sealed conspiracy, what the official record actually documents is a catastrophic institutional failure: CCTV footage shows that the two guards failed to perform the required institutional count at 10:00 p.m., Epstein was not checked every 30 minutes in violation of the jail's normal procedure, and the two guards assigned to check his cell overnight fell asleep at their desk for about three hours and later falsified related records. Additionally, there is evidence of perhaps as many as three attempts by Epstein to kill himself; given that risk, corrections officials failed to follow appropriate protocols — including leaving Epstein alone and unsupervised — and that failure contributed to his death. Crucially, Epstein had signed a new will two days before he died. On August 18, 2019, it was reported that Epstein had signed his last will and testament on August 8, two weeks after being found injured in his cell and two days before his death.

There is a legitimate and serious kernel of concern buried in this conspiracy theory, and it deserves direct acknowledgment. The procedural failures at the Metropolitan Correctional Center were not trivial. The OIG determined MCC New York staff engaged in significant misconduct and dereliction of their duties; the combination of negligence, misconduct, and outright job performance failures documented in the report all contributed to an environment in which arguably one of the most notorious inmates in BOP's custody was provided with the opportunity to take his own life. It is also true that Epstein was put on suicide watch after being found in his cell with bruises on his neck, only to be taken off the watch a day later; despite an email being sent to over 70 prison employees notifying them that Epstein needed to be housed with a cellmate, he was alone in his cell on the evening of August 9 and into the next morning when he died. Public skepticism about a justice system that allowed a wealthy, well-connected sex offender to die before trial — and thus protected everyone he might have implicated — is understandable. Epstein's death has fueled numerous conspiracy theories, particularly on the far right, because of his ties to the wealthy and powerful. But there is a critical difference between demanding accountability for real institutional failures and treating an ambiguous two-word number jotted on a legal pad as cryptographic proof of a state-ordered killing. The theory hijacks justified outrage and redirects it away from the actual, documented, prosecutable failures — falsified records, derelict guards, a broken camera system, premature removal from suicide watch — and toward an unfalsifiable narrative of omnipotent "deep state" control. That pivot is precisely what makes such theories harmful: they absorb the energy of legitimate scrutiny into a framework designed to produce no accountability, no arrests, and no reforms, because its claims can never be tested or resolved. Tens of thousands of new files have been released by the DOJ, and nothing in them challenges the ruling that Epstein died by suicide.
