The theory under examination holds that Joe Biden personally directed the criminal prosecutions of Donald Trump as a corrupt cover-up of Biden family wrongdoing; that newly surfaced evidence from Florida proves widespread fraud in the 2020 election; and that Anthony Fauci and other officials will face execution for crimes against humanity. Each of these claims fails under factual scrutiny — and two of the three invert the actual direction of documented prosecutorial misconduct.

On the prosecution claim: the federal investigations into Trump were deliberately structured to insulate them from presidential direction. Jack Smith was appointed as special counsel specifically to ensure the Justice Department's investigations of Trump were not perceived as politically motivated and to emphasize their independence and accountability. Attorney General Merrick Garland appointed Smith in November 2022 to lead a special counsel investigation, a structural choice expressly intended to create distance from the White House. The investigation was triggered not by partisan strategy but by a concrete factual record: Trump pressured Vice President Mike Pence to count fake electors instead of the electors certified by state governments, and the Department of Justice opened its investigation in January 2022 into that plot, expanding it to encompass the January 6 attack. Critically, both federal cases against Trump were ultimately dropped: after Trump's 2024 election victory, Smith sought to drop all charges, because the Justice Department by policy does not prosecute sitting presidents. If Biden were "running" a corrupt prosecution, the mechanism to end it conveniently disappeared the moment it became inconvenient to the theory's own timeline. The irony the theory ignores is that the most documented, court-recognized instance of a president directing the DOJ against political opponents runs in the opposite direction: Trump publicly demanded prosecutions of specific political opponents and labeled them criminals in advance, and former Attorney General Pam Bondi made clear the department was aligned with that approach. Both Letitia James and James Comey were indicted after Trump installed one of his personal lawyers, Lindsey Halligan, who had no prosecutorial experience; both defendants pleaded not guilty and accused the DOJ of vindictive prosecution, and a federal judge dismissed both cases, finding the prosecutor had been illegally appointed.

On the Florida election fraud claim: Florida did conduct genuine election security enforcement — but what it found does not remotely support the theory. Florida's 2020 election audit found 1,900 ineligible non-citizen registrations — a real administrative problem that the state's own agencies prosecuted and that is categorically different from the massive coordinated fraud the theory asserts. In total, more than 60 lawsuits challenging the 2020 results were filed in state and federal courts nationwide, and nearly all were dismissed or rejected by judges appointed by both Republican and Democratic presidents due to lack of credible evidence; Trump's own attorney general, William Barr, said the DOJ found no evidence of fraud sufficient to change the election's outcome. The Jan. 6 Select Committee's final report documented the same finding from inside the Trump campaign itself: a Trump campaign lawyer tasked with looking into voter fraud allegations recalled that he "didn't believe we were finding it" — nothing sufficient to alter the results of the election. The leaders of CISA, the U.S. Election Assistance Commission, and national associations of election officials called the 2020 election "the most secure in American history." The theory's framing — that "auditors" and "whistleblowers" hold suppressed proof — is the classic unfalsifiable structure: any absence of corroborating evidence becomes itself evidence of suppression, making the claim immune to refutation by design. What the theory calls "new evidence" consists of unverified affidavits, statistical anomalies from voter rolls (which reflect routine data issues such as outdated addresses, not fraudulent votes), and source-code analyses that have not survived peer or judicial review.

On the Fauci execution claim: this allegation has no factual basis. There is no evidence that any court or international body has issued criminal charges against Fauci for crimes against humanity; a search of credible media found no such reports, and reports involving Fauci, COVID, and any criminal tribunal would not go unnoticed by the press if they were true. One prominent version of this claim — that the ICC issued 14 indictments against Fauci — was traced back to a self-described parody Facebook page. Calls to prosecute Fauci for unspecified crimes have become a rallying cry among some on the right, but House Republicans acknowledged they could not point to specific crimes even when pushing for criminal referrals. Rhetoric about execution for a public health official who has not been charged with any crime — let alone convicted — represents incitement dressed as legal accountability.

There are legitimate concerns embedded in this theory that were hijacked into an unfalsifiable narrative. Public anxiety about DOJ independence, conflicts of interest in pandemic policymaking, and the concentration of prosecutorial power in the executive branch are real and serious issues across administrations. The idea that the White House should not interfere with the DOJ is a widely accepted constitutional norm, and post-Watergate reforms requiring documented communications between the White House and DOJ on specific cases became deeply rooted in the public's understanding of just and transparent federal government. That norm is genuinely under pressure today — but the threat documented by courts and legal scholars runs opposite to what this theory claims, with key Justice Department officials having proudly characterized themselves as working directly on Trump's behalf, a major breach of the department's independence. The "Sunshine State Showdown" narrative takes real institutional friction and legitimate grievances about government accountability, strips them of factual grounding, and reassembles them into a closed loop in which every piece of disconfirming evidence — every court dismissal, every bipartisan certification, every Republican official's confirmation of results — becomes proof of how deep the conspiracy runs. That structure is not investigative. It is the architecture of a belief system that cannot be falsified, and it has produced concrete harm: Fauci has blamed Republican attacks for inciting threats against him and his family, and Trump campaign attorney Joseph diGenova called for former CISA Director Chris Krebs to be shot, leading Krebs to file a defamation suit and prompting his young son to ask "Daddy's going to get executed?" Disinformation at this temperature does not merely mislead — it endangers people whose only offense was doing their jobs.
